​1. Service Description

 

1.1. Core Service: SendModels provides an automated service for compiling a talent profile (including personal data, measurements, photos, and videos) and submitting that profile to a curated list of up to 20 modeling, acting, music, or talent agencies/managers in a specific geographic market selected by the user.

1.2. Limitation of Service: SendModels acts solely as a submission facilitator. We do not act as a talent agent, manager, or employer. We do not provide employment, casting, or contract negotiation services.

 

2. Fees, Payments, and Refunds

 

2.1. Submission Fee: The use of the core submission service is subject to a one-time, non-refundable fee of $10 USD per submission.

2.2. Payment Processing: All payments are processed through secure third-party payment processors. SendModels does not store sensitive payment information.

2.3. No Refund Policy: All fees paid to SendModels are strictly non-refundable. This includes, but is not limited to, situations where: (a) a user enters incorrect information; (b) a user does not receive a response from any agency; or (c) a user later decides to withdraw their application. The fee covers the execution of the submission service, which occurs immediately upon payment confirmation.

 

3. Acknowledgement and No Guarantee

 

3.1. User Acknowledgement: By using the Service, you acknowledge that SendModels makes absolutely no guarantee that you will receive a response from any agency, secure an interview, or obtain a contract. The decision to contact or represent a user is solely at the discretion of the receiving agency or manager.

3.2. Response Time: SendModels has no control over the response times or interest levels of the agencies receiving your profile.

 

4. User Representations and Content

 

4.1. Accuracy: You represent and warrant that all information, measurements, and data provided in your application are true, accurate, and current.

4.2. Ownership of Content: You retain all intellectual property rights to the photos and videos you submit. However, you grant SendModels a non-exclusive, worldwide, royalty-free license to use, reproduce, and transmit your content solely for the purpose of providing the core submission service to the agencies.

4.3. Content Restrictions: You warrant that your content does not violate any third-party rights, including copyright, privacy, or publicity rights. Content must be suitable for professional review and must not be illegal, defamatory, or hateful.

 

5. Limitation of Liability

 

5.1. Disclaimer: SendModels shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, including but not limited to any loss of opportunity, loss of contract, or damages resulting from communication (or lack thereof) with the receiving agencies.

 

6. Governing Law

 

These Terms shall be governed and construed in accordance with the laws of New Mexico, U.S.A., specifically in the City of Albuquerque, without regard to its conflict of law provisions.
